1.Agreement

These terms are an agreement between you and Constantia Technologies LLC, a Georgia limited liability company ("we", "us"), which operates Persto. By downloading, installing, or using Persto ("the app"), you agree to them. If you do not agree, do not use the app. Your use of the app is also governed by our Privacy Policy, which is part of these terms.

2.Who may use Persto

You must be at least 13 years old, or the minimum age of digital consent in your country if that is higher. If you are under 18, you should have a parent or guardian review these terms with you. Persto is not directed to children under 13.

You should not use Persto to guide your training if a medical professional has advised you against exercise, unless they have cleared it.

3.Not medical advice

Persto is a fitness and accountability tool, not a medical device. It does not diagnose, treat, cure, or prevent any condition, and nothing it shows you is medical advice. Readiness scores, training load and trend charts, calorie and protein targets, suggested loads, and rest and recovery suggestions are estimates produced from data your device collected. They can be wrong.

Always consult a qualified professional before starting, changing, or stopping an exercise programme, and stop exercising and seek help if you feel unwell. If you think you are having a medical emergency, call your local emergency number. Do not wait for an app to tell you something is wrong, because it cannot.

You are responsible for training within your own limits. You use the app at your own risk.

4.Food and allergies

Persto does not log food. There is no food diary, no barcode scanning, no meal photos and no product database in the app. The only nutrition figures it produces are a daily calorie and protein target estimated from the profile you entered.

The current Apple app does not ask for or use allergy data. If an older beta profile still contains allergy information, the You screen explains that it is unused and provides a removal button. Because nothing in the app logs a meal or reads a label, nothing in the app checks a specific food against your allergies.

Never rely on Persto to decide whether a food is safe for you. Read the actual packaging, and take medical advice about your own allergies from a professional.

5.Your licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Persto on devices you own or control, for your own non-commercial use. You may not copy, modify, reverse engineer, decompile, resell, or redistribute the app, except where that restriction is prohibited by law.

6.Acceptable use

Do not use Persto to break the law, to harass anyone, to interfere with or overload this website's forms, or to attempt to gain access to data that is not yours. The app has no shared database and no way to publish anything to other people. If that ever changes, do not submit anything false, offensive, infringing, or that includes another person's information, and we may remove submissions without notice.

7.Accounts and signing in

There is no Persto account or fitness-data backend. We hold no user record, no password and no copy of your training. The core training experience works signed out, and nothing requires Sign in with Apple.

Sign in with Apple is offered for one purpose: if the sending phone is signed in when you hand your data to another iPhone, the receiving phone must sign in with the same Apple Account. Persto receives the app-specific identifier Apple issues, holds it on the device, and asks Apple for neither your name nor your email address. Sign out under You to remove it. The deletion page covers that and every other copy of your data.

8.Persto Plus, subscriptions and billing

The app is free to download and most of it is free to use. Persto Plus is an optional auto-renewing subscription. It is sold and billed by Apple through your Apple Account, not by us directly, and Persto is not told who subscribed.

Public App Store availability will be announced when ready. These terms apply whenever you use the app, including a TestFlight build.

What Plus unlocks. Four things: your next working weight worked out from the sets you logged, the coach's daily note, the trajectory card and the coach conversation. Everything else in the app is free, including your history, your streak, your badges, readiness and recovery guidance, guided sessions, the Apple Watch app, exporting or restoring your own data, and manually saving, restoring or deleting selected display name and coach voice preferences in iCloud.

• Price. In the United States, 4.99 USD per month or 39.99 USD per year. Prices elsewhere are set by the App Store for your region. The price and the period are shown in the app before you buy, and that price is the one that applies.
• Introductory offer. Eligible new subscribers may receive a seven-day free trial. The App Store purchase screen shows whether an offer is available to your Apple Account before you confirm. Cancel before an active trial ends to avoid renewal. Any unused part of a free trial may be forfeited if you buy the subscription while the trial is still running.
• Payment. Charged to your Apple Account when you confirm the purchase, or at the end of the free trial if you took one.
• Renewal. The subscription renews automatically unless you cancel it at least 24 hours before the current period ends. Apple charges the renewal within the 24 hours before the period ends, at the rate for the plan you chose.
• Managing and cancelling. Do both in your Apple Account settings, the same place as every other subscription. We cannot cancel it for you and we do not put a step in front of it. Cancelling stops the next renewal and does not shorten the period you already paid for. Deleting the app does not cancel a subscription.
• Refunds. Handled by Apple under the App Store's refund policy. We can ask Apple to look at a case, but we cannot refund an App Store purchase ourselves.
• Changes. We may change what is included in Plus, or its price, with notice. Changes do not apply to a period you have already paid for.

A lapsed subscription never locks you out of your own data. Exporting your data and restoring it never require an active subscription, and your on-device data is unaffected by subscription status.

9.Your data and backups

Your health and training data belongs to you. It is stored in the app's private storage on your device, protected by the device's own encryption and kept out of device cloud backups, as described in the Privacy Policy.

Backups you export are encrypted with a passphrase you choose and we never receive. If you lose that passphrase, the backup cannot be decrypted by anyone, including us, and we cannot recover it for you. You are responsible for keeping your own backups and passphrase safe.

10.Availability, and changes to the app

Persto is offered as is. We may change, suspend, or discontinue features, and we do not promise the app will be uninterrupted or error free. Some features depend on things outside our control, including Apple Health, iCloud, the App Store, and your device's own sensors, and can stop working for reasons we cannot fix.

Where these terms describe how the app behaves, they describe the iPhone and Apple Watch app. A separate Android build of Persto exists, shares the same tested engine, and differs in how it reaches the platform's health data and alarms.

11.Disclaimers

To the fullest extent permitted by law, Persto is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

Nothing in these terms excludes or limits any right you have that cannot be excluded or limited by law, including consumer rights in your country.

12.Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or personal injury arising from your use of the app. Our total liability for any claim relating to the app is limited to the greater of the amount you paid us for Persto in the twelve months before the claim, or twenty five US dollars.

13.Termination

You can stop using Persto at any time by uninstalling it. We may suspend or end your access if you breach these terms. Sections that by their nature should survive termination, including sections 3, 4, 9, 11 and 12, survive it.

14.Changes to these terms

We may update these terms. Material changes will be reflected by a new effective date, and continuing to use the app after that date means you accept the updated terms.

15.Governing law

These terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law rules, except where the mandatory law of your country of residence gives you stronger protection, in which case that law applies.
